Buyers have more protection in other states


In West Virginia, a dealer cannot sell a used car “as is” — the buyer must be able to drive it for a “reasonable” period of time before the deal is final.

In Arizona, there is a presumed warranty, for 15 days or 500 miles after a sale, that a vehicle will operate as intended.

And in Massachusetts — one of six states with a used-car “lemon law” — buyers can return vehicles for a refund within 14 days of a sale if they fail to pass a state safety inspection.

But buy a used car in Kentucky or Indiana “as is” and you’re generally stuck with it — even if it breaks down on your way home.

Kentucky and Indiana are among the states that allow dealers to waive what is known as “the implied warranty of merchantability,” or the presumption a product will serve its intended purpose — for instance, that a car will run.

And that’s not likely to change soon. In Kentucky, a bill to allow consumers to return vehicles after a three-day cooling-off period died this year without a hearing in a House committee whose chairman is a licensed used-car dealer who vows such legislation never will be heard as long as he’s in the General Assembly.
